ACVFFI in 40A and IWAF2019

The ACVFFI’s Delegation attended ICAO Assembly 40th Session, as Observer, from 24 to 28 September, in ICAO Headquarters, Montreal.

Full ACVFFI DelegationThe Delegation was formed by Ms. Pilar Vera, as Chair, Monica Maccaferri from Italian Foundazione 8 Ottobre, Dr. Bernd Gans, from Germany HIOP AF447 and 4U9525, and Ms. Raquel Sosa from Spanish AVJK5022. 

Before the 40th Assembly, ACVFFI attended the Innovation Fair together two affectees of ET302 air accident, Paul Njoroge, who lost his three children, his wife and his mother-in-law, and Robert Christofer Moore, who lost his daughter. ACVFFI hopes that all together can help ET302 victims.

We were working on five documents that were presented for approbation.

WP 147. Assistance of air accident victims in the airport emergency plans.

The Assembly is invited to:

  1. request the Council to consider establishing a Recommended Practice in Annex 19 for airport operators to develop appropriate plans on providing timely and effective assistance to aircraft accident victims and their families, within their emergency plans;
  2. urge the States that when they adopt such measures, consider including the Victims’ Associations that show their willingness to collaborate in the development of the same; and
  3. to remind the States of Resolution A39-27 of the Assembly and to urge the States to take preventive and appropriate measures related to safety with respect to assistance to victims

WP 149: Translation of the final safety investigation report of an accident to the language of all the countries involved.

The Assembly is invited to:

  1. urge the Council to adopt an amendment in Chapter 7 of Annex 13 to urge States to translate the Final Report of the safety investigation into the languages of the native countries of the victims and their families; and
  2. request the States, on their initiative, translate the Final Report of the investigation that is currently pending, into the languages of origin of the victims and their families, while the aforementioned amendment is being processed.

The Assembly is invited to:

  1. request again to the Council to consider upgrading the Recommended Practice 8.46 of Annex 9 recommandingStates to establish legislation, regulation, and/or policies to assist victims of air accidents and their families, in an International Standard, such that it stimulates and facilitates a global implementation;
  2. urge the Council to maintain its level of monitoring on implementation through the Universal Safety Oversight and Audit Programme (USOAP); and
  3. request the Council to consider establishing a new Annex 9 provision so that aircraft and airport operators develop appropriate plans to provide timely and effective assistance to aircraft accident victims and their families.

WP 434 Revision No. 2 Best practices on victim assistance regarding compensation of insurers

The Assembly is invited to:

  1. Remind the States of the ICAO Resolutions regarding the compensation of victims, insurers and air operators;
  2. Urge the States Members, international organizations, industry, and donors to support the best practices of insurers in the treatment of victims and exchange information through ICAO, in order to facilitate access to information for States and Internationals Organizations;
  3. Urge the Council the USOAP implements the adequate requirements so that the States contribute the best practices in terms of compliance with compensation to the victims and families of an air accident; and
  4. Organize a seminar next year on best practices in the States on the treatment of insurers/air operators.

The Assembly is invited to:

  1. Request the Council to establish an International Day of Air Crash Victims, in order to increase knowledge about the consequences on people who suffer an air accident and to attract them to another more hopeful path that allows them to continue living contributing to the common good; and
  2. Take note of the proposed date of 20 February as International Day of the Air Crash Victims and make the necessary procedures to include it in the official calendar, in addition to communicating it to all the Agents involved in world commercial aviation.
